I also have a stairway that my children can fall down. The best one I have found is 'The First Years All Clear Plastic Swing Gate'. It does have mounting hardware, but it fits perfectly and tightly in the hallway without having to mount it to the wall. It has a locking handle as well which makes it easy for adults to access and it swings open. It can also accomodate any doorway length. I found mine at Wal-Mart for less than $40. http://www.walmart.com/catalog/product.d…
Read the reviews their website as well.

The only safe one for the top of the stairs is the kind you have to drill in. They have ones that are secured into place by the suspension factor, but I( have found them to be unreliable (the baby can run up and push it over - imagine if that happened at the top of a staircase). My son easily plowed down those kinds of gates.
Could you drill in the wall and then get a carpenter or painter to repair it when you don't need the gate up anymore? I know it's a pain in the butt but you want your child to be safe.

If you cant drill can you maybe do two gates in sucession? Maybe one at the door of the room where he is and then at the steps as a precaution in case he manuevers through the first one. Two layers of protection.
My son sprung every gate we had. Uncanny but he took everything apart.
I agree that the tension gats are good but not for the top of stairs. I hope you figure out something.
